AN ACT CONCERNING A PROPERTY OWNER'S FAILURE TO RECORD A CONVEYANCE OF REAL ESTATE ON THE LAND RECORDS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subsection (a) of section 47-10 of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2013):

(a) No conveyance shall be effectual to hold any land against any other person but the grantor and his heirs, unless recorded on the records of the town in which the land lies. When a conveyance is executed by a power of attorney, the power of attorney shall be recorded with the deed, unless it has already been recorded in the records of the town in which the land lies and reference to the power of attorney is made in the deed. A conveyance shall be recorded on the records of the town in which the land lies not later than thirty days after the date of the conveyance from the grantor to the grantee. If a conveyance is received after the prescribed thirty-day period, the town clerk shall accept the conveyance for recording, provided the grantee shall be liable for payment of a fine in an amount of one hundred dollars per day for each day beyond the expiration of the thirty-day period, payable to the town in which the land lies not later than sixty days after the date on which the conveyance is recorded. A fine imposed pursuant to this subsection, if not paid when due, shall constitute a lien upon the real estate against which the fine was imposed from the date of such fine. Such lien may be continued, recorded and released in the manner provided by the general statutes for continuing, recording and releasing property tax liens.

This act shall take effect as follows and shall amend the following sections:
