AN ACT CONCERNING LIABILITY OF ZONING ENFORCEMENT OFFICERS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Subsection (c) of section 8-12a of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2011):

(c) Any zoning enforcement officer who issues a citation pursuant to an ordinance adopted under this section shall be liable for [treble] damages in any civil action if the court finds that such citation was issued frivolously or without probable cause.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To eliminate a provision allowing treble damages against a zoning enforcement officer who issues a citation when a court finds that such citation was issued frivolously or without probable cause.
