AN ACT REQUIRING A PARTY TO REIMBURSE THE STATE OR A MUNICIPALITY FOR THE WAGES OF AN EMPLOYEE WHO IS SUBPOENAED TO TESTIFY IN A LEGAL PROCEEDING.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-260 of the general statutes be amended to require that a party, who through use of a subpoena compels the attendance of a government or municipal employee at a legal proceeding, shall be responsible for payment to the state or a municipal employer the usual rate of pay for the employee for the time spent attending the legal proceeding in compliance with the terms of the subpoena.

Statement of Purpose:

To require a party who subpoenas a public employee to make payment to the public employer for the employee's time spent complying with the subpoena.
