AN ACT CONCERNING ATTORNEYS' FEES PROVISIONS IN DEPOSITORY CONTRACTS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That chapters 741c, 741d and 742 of the general statutes be amended to: (1) Include any bank or other entity that accepts and holds deposits from customers within the definition of commercial party, (2) include any customers making deposits within the definition of consumer, (3) include any written contract for any depository account within the definition of consumer contract, and (4) prohibit any bank or other entity that accepts and holds deposits from customers from including a clause in its consumer contract allowing for such bank or other entity to collect attorneys' fees from its customers if such bank or other entity prevails in a claim brought by customers based on the consumer contract.
Statement of Purpose:
To prohibit commercial parties from claiming, and being awarded attorneys' fees, if they prevail in a claim brought by their customers over issues covered by the parties' consumer contract.
