AN ACT AUTHORIZING THE TESTING OF SHELLFISH AT ALTERNATIVE LAB FACILITIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective from passage) (a) Not later than July 1, 2017, the Commissioner of Agriculture shall publish a list of all laboratory facilities in New England that meet or exceed federal standards for the testing of shellfish, regardless of whether such facility is federally certified. The commissioner shall post such list to the Internet web site of the Department of Agriculture.

(b) Notwithstanding sections 26-192b and 26-192c of the general statutes: (1) Any laboratory listed pursuant to subsection (a) of this section may provide analysis of shellfish harvested in the state for environmental quality and aquatic animal health, including, but not limited to, analysis of bacteria levels and contaminants in seawater and shellfish, marine biotoxin analysis and shellfish and fish pathology, and (2) the Commissioner of Agriculture shall accept test results from any such lab as proof of compliance with any testing requirements of said department.

(c) Notwithstanding any provision of sections 26-192b and 26-192c of the general statutes, the transportation of any shellfish to a laboratory listed pursuant to subsection (a) of this section may be made by courier service.

This act shall take effect as follows and shall amend the following sections:
