AN ACT REQUIRING AGENCY CERTIFICATION OF COMPLIANCE WITH STATUTORY REQUIREMENTS TO ADOPT REGULATIONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 4-170b of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2015):

On or before December first of each year, each agency shall submit in writing or electronically to the standing legislative regulation review committee:

(1) (A) A list of every section of the general statutes or of any public act that requires the agency to adopt regulations on or before January first of such year if the agency [(A)] (i) has not submitted the proposed regulations to the committee as provided in section 4-170 by said December first, or [(B)] (ii) submitted proposed regulations which were rejected without prejudice by the committee and the agency has not resubmitted the proposed regulations to the committee as provided in section 4-170 by said December first;

[(2)] (B) A date by which the agency proposes to submit or resubmit each of the proposed regulations; and

[(3)] (C) An explanation [in writing] by the administrative head of the agency of the reasons each such proposed regulation was not submitted or resubmitted to the committee on or before the date by which the agency is required by the general statutes or any public act to adopt the regulation; [.] or

(2) A statement by the administrative head of the agency certifying that the agency (A) has complied with all sections of the general statutes or public acts requiring the agency to adopt regulations on or before January first of such year, or (B) was not required by any statute or public act to adopt regulations during such period.

This act shall take effect as follows and shall amend the following sections:
