AN ACT CONCERNING EMPLOYERS AND HEALTH CARE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2013) (a) As used in this section, (1) "business entity" means a corporation, association, partnership, limited liability company, limited liability partnership, or other legal entity, not including the state or any department, agency or political subdivision thereof, and (2) "covered employer" means any business entity that (A) directly employs at least two hundred fifty employees, at least one hundred of whom are employed in the state, or (B) employs indirectly through franchisees at least two hundred fifty employees, at least one hundred of whom are employed in the state.

(b) Any covered employer that employs at least one employee (1) who receives assistance under HUSKY Plan, Part A or Part B, or (2) whose family, as defined in subdivision (12) of section 17b-290 of the general statutes, receives assistance under HUSKY Plan, Part A or Part B, shall pay a monthly fee to the Commissioner of Social Services for each such employee. Such fee shall be equal to the average annual cost of an employer-purchased commercial health plan for employer-based coverage within the state, as determined by the commissioner, divided by two thousand eighty and multiplied by the number of hours such employee worked for such covered employer during the previous calendar month. The commissioner shall collect such fees, if applicable, from each covered employer not later than sixty days after the completion of any calendar month in which such fees were assessed.

(c) The commissioner shall adopt regulations, in accordance with chapter 54 of the general statutes, for the determination of and collection of fees pursuant to subsection (b) of this section.

(d) The Attorney General may investigate any violation of subsection (b) of this section. Any information obtained pursuant to this investigation shall be exempt from disclosure under section 1-210 of the general statutes. If the Attorney General finds that a covered employer has violated or is violating any provision of subsection (b) of this section, the Attorney General may bring a civil action in the superior court for the judicial district of Hartford under this section in the name of the state against such covered employer.

This act shall take effect as follows and shall amend the following sections:
