AN ACT PREVENTING A LABOR ORGANIZATION FROM WAIVING AN EMPLOYEE'S RIGHT TO BRING A CIVIL ACTION FOR A CIVIL RIGHTS VIOLATION AGAINST AN EMPLOYER.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2010, and applicable to collective bargaining agreements entered into on or after October 1, 2010) No labor organization, as defined in section 31-101 of the general statutes, shall agree in any collective bargaining agreement to waive the right of any employee, as defined in said section 31-101, to bring a civil action against such employee's employer, as defined in said section 31-101, for said employer's deprivation of the employee's civil rights.

This act shall take effect as follows and shall amend the following sections:

Section 1

October 1, 2010, and applicable to collective bargaining agreements entered into on or after October 1, 2010

Statement of Purpose:

To prevent labor organizations from bargaining away the rights of an employee to bring a civil action for an employer's violation of said employee's civil rights.
