AN ACT CONCERNING THE BURDEN OF PROOF IN SPECIAL EDUCATION HEARINGS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That subdivision (1) of subsection (d) of section 10-76h of the general statutes be amended to shift the burden of proof to the party requesting the hearing in special education hearings to determine educational placement.
Statement of Purpose:
To shift the burden of proof to parents in special education hearings.
