AN ACT PERMITTING THE SUSPENSION OF ADMINISTRATIVE PENALTIES IMPOSED ON CERTAIN BUSINESS ENTITIES.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That title 4 of the general statutes be amended (1) to permit state agencies to suspend civil penalties assessed against any business entity for a first-time violation of any provision of a regulation of such state agency, upon the request of such business entity, if the business entity takes remedial measures that completely correct the violation not later than thirty days after the assessment of such penalty, except that no state agency shall suspend a penalty (A) for a wilful or grossly negligent violation, (B) for a violation that results in the bodily injury of any person, or (C) that is required under federal law; and (2) to permit any business entity to appeal a state agency denial of its request for suspension.

Statement of Purpose:

To permit the suspension of administrative penalties imposed on certain business entities.
