AN ACT CONCERNING THE COLLECTION OF SEXUAL ASSAULT EVIDENCE FROM AN INTOXICATED OR INCAPACITATED VICTIM.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 19a-112a of the general statutes be amended to require the Commission on the Standardization of the Collection of Evidence In Sexual Assault Investigations to study whether said section should be amended to permit the timely collection of forensic evidence from a victim of a sexual assault who is unable to provide consent to the collection of sexual assault evidence because such victim is intoxicated or otherwise incapacitated.

Statement of Purpose:

To study whether to amend the sexual assault evidence collection protocol to permit the collection of forensic evidence from a victim of a sexual assault who is unable to provide consent because such victim is intoxicated or otherwise incapacitated in order to ensure that evidence is collected in a timely manner and not lost.
