An act to add Section 125055.1 to the Health and Safety Code, relating to public health.

Existing law requires the State Department of Public Health to administer a statewide program for prenatal testing for genetic disorders and birth defects, including, but not limited to, ultrasound, amniocentesis, chorionic villus sampling, and blood testing. Existing law requires the department to expand prenatal screening to include all tests that meet or exceed the current standard of care as recommended by nationally recognized medical or genetic organizations and to establish any rules, regulations, and standards for prenatal diagnostic testing and the allocation of subsidies, as specified.
This bill would prohibit the department, by way of rule, regulation, contract, or any other manner, from interfering with a pregnant individual’s ability to secure genetic screening testing as recommended or ordered by the pregnant individual’s prenatal care provider, or both.

The people of the State of California do enact as follows:


SECTION 1.

 Section 125055.1 is added to the Health and Safety Code, to read:

125055.1.
 The department shall not, by way of rule, regulation, contract, or any other manner, interfere with a pregnant individual’s ability to secure genetic screening testing as recommended or ordered by the pregnant individual’s prenatal care provider, or both.
