   An act to add Section 44274.9 to the Health and Safety Code,
relating to air resources.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 40, as amended, Gaines. Air Quality Improvement Program:
vehicle rebates.
   Existing law establishes the Air Quality Improvement Program,
administered by the State Air Resources Board, to fund, upon
appropriation by the Legislature, air quality improvement projects
related to fuel and vehicle technologies, including incentives for
various types of vehicles.
   This bill would require incentives for qualifying 
zero-emission, battery-electric  passenger vehicles under the
Clean Vehicle Rebate Project of the Air Quality Improvement Program
to be limited to  passenger  vehicles  in that
category  with a manufacturer's suggested retail price of
$40,000 or less. The bill would require the rebate for qualifying
 zero-emission, battery-electric  passenger vehicles to be
$3,500, subject to availability of funds.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 44274.9 is added to the Health and Safety Code,
to read:
   44274.9.   (a)    Incentives for qualifying 
zero-emission, battery-electric  passenger vehicles under the
Clean Vehicle Rebate Project established as part of the Air Quality
Improvement Program shall be limited to  passenger 
vehicles  in that category  with a manufacturer's suggested
retail price of forty thousand dollars ($40,000) or less. The rebate
for qualifying  zero-emission, battery-electric  passenger
vehicles shall be three thousand five hundred dollars ($3,500),
subject to availability of funds. 
   (b) This section does not apply to any other Clean Vehicle Rebate
Project vehicle category or rebate.
