An act to add Article 16 (commencing with Section 2380) to Chapter 5 of Division 2 of the Business and Professions Code, relating to healing arts.

AB 370, as amended, Voepel. Physicians and surgeons: forms: fee limitations.
Existing law, the Medical Practice Act, provides for the licensure and regulation of the practice of medicine by physicians and surgeons. Existing law establishes the Medical Board of California within the Department of Consumer Affairs to enforce the licensing and regulatory provisions in the act.
This bill would limit the amount that a physician and surgeon licensee may charge a patient for filling out medical forms, including applications for state disability insurance, as specified. The bill would authorize the Medical Board of California to annually increase the fee amount permitted up to $1 per year. by an amount equal to the increase in the California Consumer Price Index.

The people of the State of California do enact as follows:


SECTION 1.

 Article 16 (commencing with Section 2380) is added to Chapter 5 of Division 2 of the Business and Professions Code, to read:
Article  16. Medical Forms

2380.
 (a) Subject to subdivision (b), a physician and surgeon shall not charge a fee to a patient for filling out medical forms, including forms to apply for state disability insurance, that exceeds twenty-five dollars ($25) for each form.
(b) The limitation on fees applies only to forms subsequently filled out by the licensee after the initial form is completed.
(c) Subject to Section 2001.1, the Medical Board of California may annually increase the amount of fees permitted to be charged under this section, in section by an amount that does not exceed one dollar ($1) per calendar year. equal to the increase in the California Consumer Price Index.
