An act to amend Section 22576 of the Business and Professions Code, relating to privacy.

AB 2826, as introduced, Muratsuchi. Privacy: internet privacy requirements.
Existing law requires an operator of a commercial website or online service that collects personally identifiable information through the website or online service from individual consumers who use or visit the commercial website or online service and who reside in California to comply with specified provisions. Noncompliance, as described, constitutes a violation of these provisions.
This bill would make nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:


SECTION 1.

 Section 22576 of the Business and Professions Code is amended to read:

22576.
 An operator of a commercial Web site website or online service that collects personally identifiable information through the Web site website or online service from individual consumers who use or visit the commercial Web site website or online service and who reside in California shall be in violation of this section if the operator fails to comply with the provisions of requirements specified in Section 22575 or with the provisions of its posted privacy policy in either of the following ways:
(a) Knowingly and willfully.
(b) Negligently and materially.
