An act to add and repeal Section 89562 of the Education Code, relating to public postsecondary education.

Existing law establishes the California State University, administered by the Trustees of the California State University, as one of the segments of public postsecondary education in this state. The California State University comprises 23 institutions of higher education located throughout the state. Existing law authorizes the trustees to appoint one or more persons to constitute a police department for the headquarters and for each campus of the California State University.

This bill would state the intent of the Legislature to enact subsequent legislation that would require the California State University to designate a trauma-informed crisis response team on each campus to response to noncriminal health and safety incidents and interpersonal conflicts among campus community members, as specified.

This bill would require the Chancellor of the California State University, on or before July 1, 2023, to convene a stakeholder workgroup that includes a representative from specified stakeholders, including faculty, staff, and students. The bill would require the stakeholder workgroup, at a minimum, to evaluate and report on alternative options to current emergency response programs on the campuses of the California State University and alternative dispute resolution options to resolve employee conflicts. The bill would require the stakeholder workgroup to submit a report to the Legislature on or before October 1, 2023, that includes recommendations to alleviate concerns of current emergency response programs on the campuses of the California State University. The bill would repeal these provisions on July 1, 2027.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) A trauma-informed crisis response team is a valuable service that should be available on each campus of the California State University.
(b) The crisis response team on each campus should respond to noncriminal health and safety incidents, including, but not limited to, classroom disruptions and interpersonal conflicts among campus community members.
(c) A crisis response team should be separate and distinct from campus police departments and local law enforcement, and be trained in dispute resolution and restorative justice.

SEC. 2.

 Section 89562 is added to the Education Code, to read:

89562.
 (a) On or before July 1, 2023, the Chancellor of the California State University shall convene a stakeholder workgroup that includes, but is not limited to, a representative from all of the following stakeholders:
(1) Faculty.
(2) Staff.
(3) Students.
(4) Campus health and safety personnel.
(5) Bargaining unit representatives.
(b) On or before October 1, 2023, the stakeholder workgroup shall submit a report to the Legislature that includes recommendations to alleviate concerns of current emergency response programs on the campuses of the California State University.
(c) In preparing the report pursuant to subdivision (b), the stakeholder workgroup shall, at a minimum, evaluate and report on both of the following:
(1) Alternatives to current procedures and processes for responding to nonviolent and noncriminal situations on the campuses of the California State University.
(2) Alternative dispute resolution options to resolve employee conflicts.
(d) (1) A report to be submitted pursuant to subdivision (b) shall be submitted in compliance with Section 9795 of the Government Code.
(2) Pursuant to Section 10231.5 of the Government Code, this section is repealed on July 1, 2027.

SECTION 1.

It is the intent of the Legislature to enact subsequent legislation that would require the California State University to do all of the following:

(a)Designate a trauma-informed crisis response team on each campus to respond to noncriminal health and safety incidents, including, but not limited to, classroom disruptions, and interpersonal conflicts among campus community members.

(b)Establish the crisis response teams as separate from campus police departments or local law enforcement.

(c)Train the crisis response teams in dispute resolution and restorative justice.

(d)Require the crisis response teams to regularly report to the California Faculty Association chapter at each campus.
