An act to amend Section 2206 of the Elections Code, relating to elections.

AB 1688, as amended, Sanchez. Voter registration: cancellation: deceased persons.
Existing law requires the Secretary of State to adopt regulations to facilitate the availability of death statistics from the State Department of Health Services for use by the Secretary of State and county elections officials to cancel affidavits of registration of deceased persons.
This bill would additionally require authorize the Secretary of State to adopt regulations also seek an agreement with the federal Social Security Administration to facilitate the availability of death statistics from the federal Social Security Administration for the same purpose. statistics from that agency. The bill would require the Secretary of State, upon obtaining such an agreement, to adopt regulations as specified. Beginning on January 1, 2026, this bill would also require the Secretary of State and county elections officials to use information obtained pursuant to these provisions to cancel affidavits of registration of deceased persons. By imposing new duties on county elections officials, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:


SECTION 1.

 Section 2206 of the Elections Code is amended to read:

2206.
 (a) The Secretary of State shall adopt regulations to facilitate the availability of death statistics from the State Department of Health Services and from the federal Social Security Administration. The data shall be used by the Secretary of State or county elections officials in canceling the affidavit of registration of deceased persons. Services.
(b) (1) The Secretary of State is authorized to seek an agreement with the federal Social Security Administration to facilitate the availability of death statistics.
(2) Upon obtaining an agreement with the federal Social Security Administration pursuant to paragraph (1), the Secretary of State shall adopt regulations, to be implemented by January 1, 2026, governing the electronic transfer of death statistics from that agency.
(c) Beginning on January 1, 2026, the Secretary of State and county elections officials shall use any data obtained pursuant to this section to cancel the affidavits of registration of deceased persons.

SEC. 2.

 If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
