An act to amend Section 29.2 of the Penal Code, relating to crimes.

AB 1414, as introduced, Cunningham.
Crimes: intent.
Under existing law, the intent to commit a crime is manifested by the circumstances connected with the offense. In the guilt phase of a criminal action or a juvenile adjudication hearing, existing law makes evidence that the accused lacked the capacity or ability to control their conduct inadmissible on the issue of whether they had any mental state with respect to the commission of any crime.
This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:
SECTION 1.
Section 29.2 of the Penal Code is amended to read:29.2.
(a) The intent or intention is manifested by the circumstances connected with the offense.(b) In the guilt phase of a criminal action or a juvenile adjudication hearing, evidence that the accused lacked the capacity or ability to control his or her their conduct for any reason shall not be admissible be inadmissable on the issue of whether the accused actually had any mental state with
respect to the commission of any crime. This subdivision is not applicable does not apply to Section 26.
