BILL NUMBER: AB 1062 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Dickinson FEBRUARY 18, 2011 An act to amend Section 1294 of the Code of Civil Procedure, relating to arbitration. LEGISLATIVE COUNSEL'S DIGEST AB 1062, as introduced, Dickinson. Arbitration: appeals. Existing law specifies those types of orders and judgments from which an appeal may be taken, including, an order dismissing or denying a petition to compel arbitration. This bill would delete an order dismissing or denying a petition to compel arbitration as a basis from which an appeal may be taken. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 1294 of the Code of Civil Procedure is amended to read: 1294. An aggrieved party may appeal from any of the following :(a) An order dismissing or denying a petition to compel arbitration.(b)(a) An order dismissing a petition to confirm, correct , or vacate an award.(c)(b) An order vacating an award , unless a rehearing in arbitration is ordered.(d)(c) A judgment entered pursuant to this title.(e)(d) A special order after final judgment.
