   An act to add Section 8314.4 to the Government Code, relating to
public funds.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 10, as introduced, Hagman. Public funding: actions.
    Existing law makes it unlawful for any elected state or local
officer, appointee, employee, or consultant to use, or permit others
to use, state resources for a campaign activity, or personal or other
purposes that are not authorized by law.
   This bill would additionally prohibit those officials, officers,
directors, appointees, employees, agents, or consultants, or those
organizations or associations that represent local agencies from
using, or permitting others to use, public resources to commence an
action to enjoin the operation of any law or constitutional
amendment, proposed by initiative petition and approved by the people
at a general election or a special election.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 8314.4 is added to the Government Code, to
read:
   8314.4.  (a) A local agency or state agency, or any organization
or association that represents local agencies that is funded, in
whole or in part, by dues or other voluntary payments made by local
agencies, shall not use, or permit others to use, public resources to
commence an action to enjoin the operation of any law or
constitutional amendment that was proposed by initiative petition and
approved by the people at a general election or a special election.
   (b) For purposes of this section, "public resources" and "use"
shall have the same meaning as defined in subdivision (b) of Section
8314. "Local agency" means a city, county, city and county, district,
redevelopment agency, school district, community college district,
joint powers authority, or any other political subdivision or public
corporation of the state.
