proposing an amendment to the Constitution of Arizona; amending article II, section 31, Constitution of Arizona; relating to damages for death or personal injuries.

Be it resolved by the Senate of the State of Arizona, the House of Representatives concurring:

1.  Article II, section 31, Constitution of Arizona, is proposed to be amended as follows if approved by the voters and on proclamation of the Governor:

START_STATUTE31.  Damages for death or personal injuries

Section 31.  No law shall be enacted in this state limiting the amount of damages to be recovered for causing the death or injury of any person, except that:

1.  Public school teachers are not subject to punitive damages for any act or failure to act related to classroom discipline.

2.  Public schools are not subject to punitive damages but are subject to compensatory damages in an amount that does not exceed the economic injuries sustained. END_STATUTE

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
