SENATE BILL 1369

 

 

 

AN ACT

 

amending title 28, chapter 1, article 3, Arizona Revised Statutes, by adding section 28‑145; relating to transportation.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 28, chapter 1, article 3, Arizona Revised Statutes, is amended by adding section 28-145, to read:

START_STATUTE28-145.  Regulation of motor vehicle fuels and fueling infrastructure; legislative authority; definitions

A.  Notwithstanding any other law, the corporation commission or a state agency may not adopt or enforce a state or regional program to regulate motor vehicle fuel for light class motor vehicles or use class motor vehicles or fueling infrastructure without express legislative authority.  Nothing in this section is intended to prohibit the corporation commission from setting electricity rates.

B.  For the purposes of this section:

1.  "Fueling infrastructure" means the structures, facilities and equipment that provide the delivery of any type of motor vehicle fuel.

2.  "Light class motor vehicle" has the same meaning prescribed in section 28-5601.

3.  "Motor vehicle fuel" means the energy sources that power motor vehicles, including those derived from petroleum, natural gas, electricity, hydrogen and synthetic fuels.

4.  "Use class motor vehicle" has the same meaning prescribed in section 28-5601. END_STATUTE
