AN ACT
amending sections 28-6922 and 41-1252, Arizona Revised Statutes; relating to highway construction projects.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 28-6922, Arizona Revised Statutes, is amended to read:
28-6922. Director; powers and duties
A. Except as provided in subsection C of this section, the director of the department of transportation or the director's authorized and bonded agent shall administer all highway and maintenance work and has the following powers and duties:
1. Direct the preparation of all plans and specifications for work on state highways or state routes.
2. Advertise for competitive bids for work on state highways or state routes and, on authorization of the transportation board, award and enter into contracts for the work.
3. Direct the supervision of all construction work on state highways and state routes and is in charge of maintenance and upkeep of these highways and routes.
4. Approve payment for work done by the state on or in connection with state highways or state routes, except that the director of the department of administration shall not allow a claim for work without the approval of the director of the department of transportation or the director's authorized and bonded agent.
5. Negotiate and award contracts to private consulting engineers or consulting engineering firms if deemed in the public interest by the director and the transportation board for the performance of engineering work that is required to formulate and complete highway construction contracts.
B. The director shall:
1. Direct the organization of the division.
2. Appoint, suspend, discharge and fix the duties of employees.
3. Adopt rules for the conduct of employees.
4. Make monthly reports to the transportation board of all expenditures of the division, of the work accomplished and other applicable information.
5. On request of the transportation board, assign clerks or other employees to the board.
6. Prescribe procedures for the use of division personnel, facilities, equipment, supplies and other resources in assisting search or rescue operations.
7. Exercise other powers necessary to carry out the work of the division and perform other duties prescribed by law for the division.
C. Before the director may proceed with a highway construction project that exceeds a total cost of fifteen million dollars, The joint committee on capital review shall review the highway construction project. Projects shall not be artificially divided to avoid review by the joint committee on capital review.
Sec. 2. Section 41-1252, Arizona Revised Statutes, is amended to read:
41-1252. Powers and duties; staffing
A. The joint committee on capital review shall:
1. Develop and approve a uniform formula for computing annual building renewal funding needs and a uniform format for the collection of data for the formula pursuant to section 41‑793.01.
2. Approve building systems for the purposes of computing and funding building renewal pursuant to section 41‑793.01 and for preparing capital improvement plans pursuant to section 41‑793.
3. Review the state capital improvement plan prepared pursuant to section 41‑793 and make recommendations to the legislature concerning funding for land acquisition, capital projects and building renewal.
4. Review the expenditure of all monies appropriated for land acquisition, capital projects and building renewal.
5. Review highway construction projects that exceed a total cost of fifteen million dollars.
B. In making its recommendations to the legislature, the joint committee on capital review should give priority to funding fire and life safety projects.
C. Before the release of monies for construction of a new capital project that has an estimated total cost of more than two hundred fifty thousand dollars, the joint committee on capital review shall review the scope, purpose and estimated cost of the project. A construction contract shall not divide a new capital project into projects with an estimated cost of two hundred fifty thousand dollars or less for the purpose of evading committee review. The joint committee on capital review may review any capital project regardless of its cost.
D. The joint committee on capital review has the powers conferred by law on legislative committees.
E. In performing its duties, the joint committee on capital review shall be staffed by the joint legislative budget committee staff.
