AN ACT
Amending title 20, chapter 4, article 3, Arizona Revised Statutes, by adding section 20-826.05, Arizona Revised Statutes; Amending title 20, chapter 4, article 9, Arizona Revised Statutes, by adding section 20-1057.12; amending title 20, chapter 6, article 4, Arizona Revised Statutes, by adding section 20-1342.06; amending title 20, chapter 6, article 5, Arizona Revised Statutes, by adding sections 20-1402.04 and 20-1404.04; amending title 20, chapter 13, article 1, Arizona Revised Statutes, by adding section 20-2333; relating to cancer medication.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 20, chapter 4, article 3, Arizona Revised Statutes, is amended by adding section 20-826.05, to read:
20-826.05. Oral anticancer medication
A contract issued by a corporation that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the contract. A corporation shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a contract.
Sec. 2. Title 20, chapter 4, article 9, Arizona Revised Statutes, is amended by adding section 20-1057.12, to read:
20-1057.12. Oral anticancer medication
A contract or evidence of coverage issued by a health care services organization that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the contract or evidence of coverage. A health care services organization shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a contract or evidence of coverage.
Sec. 3. Title 20, chapter 6, article 4, Arizona Revised Statutes, is amended by adding section 20-1342.06, to read:
20-1342.06. Oral anticancer medication
A policy issued by a disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the policy. A disability insurer shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a policy.
Sec. 4. Title 20, chapter 6, article 5, Arizona Revised Statutes, is amended by adding sections 20-1402.04 and 20-1404.04, to read:
20-1402.04. Oral anticancer medication
A group disability policy issued by a group disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the group disability policy. A group disability insurer shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a group disability policy.
20-1404.04. Oral anticancer medication
A policy or contract issued by a blanket disability insurer that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the policy or contract. A blanket disability insurer shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a policy or contract.
Sec. 5. Title 20, chapter 13, article 1, Arizona Revised Statutes, is amended by adding section 20-2333, to read:
20-2333. Oral anticancer medication
A health benefits plan issued by an accountable health plan that provides coverage for cancer chemotherapy treatment and coverage for prescribed, orally administered anticancer medication used to kill or slow the growth of cancerous cells shall not impose any additional limitations or financial requirements for the use of prescribed, orally administered anticancer medication than those applicable to intravenously administered or injected chemotherapy agents that are covered under the health benefits plan. An accountable health plan shall not achieve compliance with this section by imposing an increase in patient out‑of‑pocket costs with respect to intravenously administered or injected chemotherapy agents covered under a health benefits plan.
Sec. 6. Applicability
This act applies to policies, contracts and plans that are issued or renewed from and after December 31, 2010.
