AN ACT
amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-119; relating to school meals.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-119, to read:
15-119. School meals; water; exception; resolution
A. Except as provided in subsection b of this section, on or before July 1, 2020, each school district and charter school shall provide access to free, fresh drinking water during meal times in the food service areas of each school, including in any area where Lunch or breakfast is served to pupils or consumed by pupils. A school district or charter school may comply with this subsection by providing cups and containers of water or soliciting or receiving donated bottled water.
B. A school district governing board or a charter school governing body may propose a resolution stating that it is unable to comply with the requirements of subsection A of this section due to specified fiscal constraints or health and safety concerns.
The governing board or governing body shall post notice of the proposed resolution on at least two consecutive meeting agendas, first as an informational item and second as an action item, before voting whether to adopt the resolution.
