SENATE BILL 1029

 

 

An Act

 

amending title 36, chapter 28.2, Arizona Revised Statutes, by adding section 36-2866; relating to marijuana.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 36, chapter 28.2, Arizona Revised Statutes, is amended by adding section 36-2866, to read:

START_STATUTE36-2866. Department of revenue; marijuana tax collections report; department of health services; analysis; enforcement

A. On or before August 31 of each year, the department of revenue shall provide to the department of health services a report of the previous fiscal year's marijuana tax collections from marijuana establishments and nonprofit medical marijuana dispensaries.

B. The department of health services shall compare the marijuana tax collections data provided pursuant to subsection A of this section to actual revenue and inventory of marijuana establishments and nonprofit medical marijuana dispensaries. The department shall report any discrepancies to the attorney general's office for investigation and enforcement action.END_STATUTE

Sec. 2. Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, section 36-2866, Arizona Revised Statutes, as added by this act, is effective only on the affirmative vote of at least three-fourths of the members of each house of the legislature.
