A CONCURRENT RESOLUTION

 

Proposing an amendment to the constitution of Arizona; amending article IV, part 2, constitution of Arizona, by adding section 26; relating to the transfer of monies to the state general fund.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article IV, part 2, Constitution of Arizona, is proposed to be amended by adding section 26 as follows if approved by the voters and on proclamation of the Governor:

26.  Transfer of monies; prohibition

Section 26.  A.  Except as provided in subsection B of this section, any taxes or fees that are collected for a specific purpose may be spent only on the purpose for which the tax or fee is collected and may not be appropriated for any other purpose.

B.  If an act repeals a tax or fee that was designated for a specific purpose, the act may direct any remaining monies that were collected for that purpose to the state general fund.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
