A CONCURRENT RESOLUTION

 

Proposing an amendment to the constitution of Arizona; amending article IV, part 2, constitution of Arizona, by adding section 26; relating to the transfer of monies to the state general fund.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article IV, part 2, Constitution of Arizona, is proposed to be amended by adding section 26 as follows if approved by the voters and on proclamation of the Governor:

26.  Transfer of monies; prohibition; definition

Section 26.  A.  Except as provided in subsection B of this section, any fees that are collected by a state regulatory entity may be spent only on the purpose for which the fee is collected and may not be appropriated for any other purpose.

B.  No more than ten per cent of the monies collected by a state regulatory entity may be transferred annually to the state general fund.

C.  For the purposes of this section, "state regulatory entity" means a department, agency, board, commission or office that regulates one or more professions in this state and that is required by law to annually transfer ten per cent of the monies it collects to the state general fund.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
