AN ACT

 

amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-116; relating to student privacy.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-116, to read:

START_STATUTE15-116.  Cloud computing services; student privacy; definitions

A.  Any person who, with knowledge that student data will be processed, provides a cloud computing service to an educational institution is prohibited from using that cloud computing service to process student data for any secondary uses that benefit the cloud computing service provider or any third party, including any of the following:

1.  Online behavioral advertising.

2.  Creating or correcting an individual or household profile primarily for the cloud computing service provider's benefit or for the benefit of any third party.

3.  The sale of the data for any commercial purpose.

4.  Any other similar commercial for-profit activity.

B.  Notwithstanding subsection A of this section, a cloud computing service may process or monitor student data solely to provide services to the educational institution and to maintain the integrity of these services.

C.  Any person who enters into an agreement to provide a cloud computing service to an educational institution shall certify in writing to the educational institution that the cloud computing service will comply with this section.

D.  For the purposes of this section:

1.  "Cloud computing service" means a service that enables convenient, on-demand network access to a shared pool of configurable computing resources to provide a student, teacher or staff member with account-based productivity applications such as e‑mail, document storage and document editing that can be rapidly provisioned and released with minimal management effort or cloud computing service provider interaction.

2.  "Cloud computing service provider" means an entity, other than an educational institution, that operates a cloud computing service.

3.  "Educational institution" means any public or private school, charter school or school district that provides instruction in kindergarten programs or grades one through twelve, or any combination of those programs or grades.

4.  "Process" or "processed" means to use, access, manipulate, scan, modify, transform, disclose, store, transmit, transfer, retain, aggregate or dispose of student data.

5.  "Student data" means any information or materials in any media or format, including the name, e‑mail address, postal address, phone number, e‑mail messages, word processing documents, unique identifiers or metadata, or any aggregations or derivatives of these items, that are created or provided by any of the following:

(a)  A student in the course of the student's use of a cloud computing service.

(b)  An employee or an agent of the educational institution that concerns a student. END_STATUTE
