AN ACT

 

amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-119; AMENDING Title 15, chapter 2, article 2, Arizona Revised Statutes, by adding section 15-249.14; repealing section 15‑249.14, Arizona Revised Statutes; relating to school buildings.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-119, to read:

START_STATUTE15-119.  School buildings; vulnerability assessments; local review boards

A.  Each school district and charter school shall have a vulnerability assessment conducted for each building that the school district or charter school owns, rents, occupies or operates.

B.  The vulnerability assessment must be conducted by persons who are certified by the Arizona peace officer standards and training board and must evaluate at least the following:

1.  The school environment's vulnerabilities to external and internal safety threats.

2.  The preparedness of school personnel to manage emergency situations.

C.  The results of the vulnerability assessments shall be submitted on or before December 15 each year to a local review board that consists of at least the following:

1.  The county school superintendent.

2.  A local law enforcement leader who is selected by the school district governing board or charter school governing body.

3.  A representative of a local emergency planning organization who is selected by the school district governing board or charter school governing body.

4.  A local fire chief who is selected by the school district governing board or charter school governing body.

D.  The local review board shall review vulnerability assessments and determine any necessary actions to remedy any vulnerabilities, including partnerships, local funding options and state funding options.  END_STATUTE

Sec. 2.  Title 15, chapter 2, article 2, Arizona Revised Statutes, is amended by adding section 15-249.14, to read:

START_STATUTE15-249.14.  Safe schools grant fund; annual report

A.  The Safe Schools Grant Fund is established consisting of appropriations and grants, gifts, devises and donations from any public or private source.  The department of Education shall administer the fund.  Monies in the fund are continuously appropriated and are exempt from the provisions of section 35-190, relating to lapsing of appropriations.  The department may retain not more than five percent of the monies deposited into the fund in any fiscal year for administrative purposes.  On notice from the department, the state treasurer shall invest and divest monies in the fund as provided by section 35-313, and monies earned from investment shall be credited to the fund.  Monies in the fund are subject to state auditing procedures.

B.  The department of education shall distribute grants from the fund to school districts and charter schools to help school sites decrease vulnerabilities to potential external and internal threats.  The department shall establish application procedures and selection criteria for school districts and charter schools to apply for grants from the fund.

C.  On or before January 1 of each year, the department shall submit a report to governor, the president of the senate and the speaker of the house of representatives that summarizes the allocation of grants from the fund and provide a copy of this report to the secretary of state.  END_STATUTE

Sec. 3.  Delayed repeal

Section 15‑249.14, Arizona Revised Statutes, as added by this act, is repealed from and after June 30, 2024.
