AN ACT
amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9‑499.16; relating to cities and towns.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-499.16, to read:
9-499.16. Parking time measuring meters; inspection; inoperative meters; presumption of nonresponsibility
A. each calendar quarter a municipality shall randomly test, inspect and calibrate ten per cent of the parking time measuring meters owned by the municipality. If the test, inspection and calibration determine that seventy‑five per cent or more of the sampled meters are operational and correct the governing body of the municipality shall certify that the municipality's parking time measuring meters are accurate.
B. If the test, inspection and calibration determine that less than seventy‑five per cent of the sampled meters are operational and correct, the municipality shall promptly test, inspect and calibrate the remaining parking time measuring meters owned by the municipality and shall repair and correct any meter that is not operational and correct. Until those meters are tested and inspected and any repairs as necessary are completed, any person who is issued a parking ticket for a violation of the municipality's ordinance regulating the standing or parking of vehicles that involves the use of a parking time measuring meter is presumed not responsible for the violation.
