AN ACT

 

amending Title 41, chapter 9, Arizona Revised Statutes, by adding article 10; relating to civil rights.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 9, Arizona Revised Statutes, is amended by adding article 10, to read:

ARTICLE 10.  GOVERNMENT CONTRACTS

START_STATUTE41-1494.  Definitions

In this article, unless the context otherwise requires:

1.  "Government" means this state, a county, city or town or a principal unit of this state, a county, a city or a town.

2.  "Government contract" means either of the following:

(a)  A contract with the government valued at $25,000 or more.

(b)  A subcontract that is valued at $10,000 or more for providing part or all of the services covered by another entity's contract with the government that is valued at $25,000 or more.

3.  "Government contractor" means a for-profit or nonprofit entity that has a government contract. END_STATUTE

START_STATUTE41-1494.01.  Nondiscrimination; government contracts

A.  It is the policy of this state that it will not do business with entities that promote or tolerate discrimination or infringement of civil rights.

B.  The government may not contract for public goods or services with any business that discriminates against employees or customers on the basis of a person's actual or perceived race, color, creed, religion, ancestry, gender, martial status, sexual orientation, gender identity or expression, physical or mental disability, national origin or age.

C.  A Government agency that contracts for public goods or services shall amend the government agency's procurement procedures to comply with this section.

D.  Any contract or contract renewal entered into by a government agency on or after the effective date of this section shall include a binding agreement consistent with this section, and a government agency may not enter into a contract with any government contractor without such a binding agreement.

E.  This section may not be affected by unduly narrow federal executive branch interpretations of existing federal statutory antidiscrimination protections. END_STATUTE
