AN ACT

 

amending Title 41, chapter 4, article 1, Arizona Revised Statutes, by adding section 41‑709; making an appropriation; relating to the department of administration.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 41-709, to read:

START_STATUTE41-709.  Teacher liability insurance; request for proposals; contract

A.  The department of administration shall issue a request for proposals to insurance carriers to provide statewide personal liability insurance to teachers employed by school districts to cover conduct that falls outside of a teacher's scope of employment and that is not already covered by the district's existing insurance coverage.  The liability insurance contemplated by this section is an alternative to the personal liability insurance provided pursuant to section 15‑502, subsection G.

B.  On or before December 31, 2012, the department shall award a contract to the insurance carrier that will provide teacher liability insurance in the most efficient and cost-effective manner.  Beginning January 1, 2013, any teacher employed by a school district may apply to receive liability insurance from the insurance carrier selected by the department pursuant to this section. Sec. 2.  Appropriation; department of administration; teacher liability insurance

The sum of $_______________ is appropriated from the state general fund in fiscal year 2012-2013 to the department of administration for the cost of supplying the liability insurance prescribed in this act.
