AN ACT

 

Amending title 17, chapter 3, article 1, Arizona Revised Statutes; relating to restricted wildlife.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 17, chapter 3, article 1, Arizona Revised Statutes, is amended by adding section 17-321, to read:

START_STATUTE17-321.  Possession of restricted wildlife; permit

A.  Beginning January 1, 2013, a person shall not own, possess, keep, harbor, import or transport into this state, have custody or control of or propagate restricted wildlife without a permit issued by the department.

B.  The department may issue a restricted wildlife permit only to:

1.  A resident of this state for one of the following purposes:

(a)  For educational display.

(b)  For the advancement of scientific knowledge or research.

(c)  To foster an animal unable to return to its natural habitat.

2.  A nonresident who moves into this state already in legal possession of restricted wildlife.

C.  The department may prescribe the terms and conditions of any restricted wildlife permit and shall adopt a list of restricted wildlife species for the purposes of this section.

D.  A game ranger, wildlife manager or peace officer may seize restricted wildlife that is in private possession in violation of this section.  Any wildlife seized pursuant to this subsection is subject to disposition as prescribed by the commission without compensation to the person originally in possession.  The person originally in possession of restricted wildlife seized pursuant to this subsection is liable for the reasonable costs of caring and providing for the wildlife during the seizure.
