AN ACT
Amending Title 30, chapter 6, Arizona Revised Statutes, by adding article 2; relating to electric power.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Heading change
A. The chapter heading of title 30, chapter 6, Arizona Revised Statutes, is changed from "ELECTRIC POWER COMPETITION" to "ELECTRIC POWER".
B. The article heading of title 30, chapter 6, article 1, Arizona Revised Statutes, is changed from "GENERAL PROVISIONS" to "ELECTRIC POWER COMPETITION".
Sec. 2. Title 30, chapter 6, Arizona Revised Statutes, is amended by adding article 2, to read:
ARTICLE 2. ELECTRIC POWER
30-821. Distributed generation; public power entity requirements; definition
A. A public power entity shall allow distributed generation customers to export electricity back to the public power entity and shall regulate the export of electricity back to the public power entity consistent with the corresponding requirements of the commission.
B. A public power entity shall reimburse distributed generation customers for the electricity that the customer exports back to the public power entity and shall set the reimbursement rate for exported electricity to be at least as much as would be set using the corresponding method required by the commission.
C. For the purposes of this section, "distributed generation customer" means a retail electric customer that does all of the following:
1. Generates electricity on the retail electric customer's premises through solar or wind or other renewable means.
2. Generates electricity primarily to provide part or all of the retail electric customer's electricity requirements.
3. Operates electricity generation equipment such that it is compatible with the public power entity's existing electric distribution facilities.
