HOUSE BILL 2493

 

 

 

AN ACT

 

Providing for the delayed repeal of section 45‑118, Arizona Revised Statutes; relating to water.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Delayed repeal

Section 45-118, Arizona Revised Statutes, is repealed from and after June 30, 2014.

Sec. 2.  Joint legislative study committee on funding department of water resources; duties; report; delayed repeal

A.  The joint legislative study committee on alternative sources of funding for the department of water resources is established.  The committee shall consist of the following members:

1.  The chairperson and vice chairperson of the House of Representatives agriculture and water committee or its successor committee and a committee member who is a member of the minority political party.

2.  The chairperson and vice chairperson of the Senate land use and rural development committee or its successor committee and a committee member who is a member of the minority political party.

3.  The director of the department of environmental quality or the director's designee.

4.  The state land commissioner or the commissioner's designee.

5.  The director of the department of water resources or the director's designee.

6.  The director of the joint legislative budget committee or the director's designee.

7.  The executive secretary of the corporation commission or the executive secretary's designee.

8.  A judicial official with water adjudication experience who is appointed by the administrative office of the courts.

B.  The committee shall study and consider user fees, formulas for renewal fees, formulas for user fees and governance models in determining an ongoing funding source for the department of water resources.

C.  Committee members shall select a chairperson from the committee membership.  Committee members are not eligible to receive reimbursement for expenses.  Members of the committee designated in subsection A, paragraphs 3 through 8 are advisory non‑voting members only and shall not be counted in determining a quorum.  At the discretion of the chairperson additional advisory, non‑voting members of the committee may be appointed by the chairperson.

D.  The committee shall submit a report regarding the committee's activities and recommendations for administrative or legislative action on or before September 30, 2012 to the governor, the president of the senate and the speaker of the house of representatives and provide a copy of this report to the secretary of state.

E.  This section is repealed from and after September 30, 2013.

Sec. 3.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
