AN ACT

 

Amending title 16, chapter 4, article 10, Arizona Revised Statutes, by adding section 16-604; repealing section 16-604, Arizona Revised Statutes; relating to election procedures.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 16, chapter 4, article 10, Arizona Revised Statutes, is amended by adding section 16‑604, to read:

START_STATUTE16-604  Election procedures oversight committee; membership; duties; annual report

A.  The election procedures oversight committee is established consisting of the following persons:

1.  Two members of the house of representatives who are appointed by the speaker of the house of representatives and who are not members of the same political party.

2.  Two members of the senate who are appointed by the president of the senate and who are not members of the same political party.

3.  One person who is appointed by the speaker of the house of representatives.

4.  One person who is appointed by the president of the senate.

5.  As a nonvoting member, the secretary of state or the secretary's designee.

B.  Members of the committee are not eligible to receive compensation but members who are appointed pursuant to subsection A, paragraphs 3 and 4 of this section are eligible for reimbursement of expenses.

C.  The committee shall meet at least annually and shall examine the collection and transfer of voting results from the 2018 and following general elections between polling places, early voting centers or other voting centers and central counting centers, including transfer by modem, public or private network or otherwise, in order to audit those transfers for accuracy and reliability.  The committee shall review election security technology and other methods of improving election security. The committee also shall have access to voter registration rolls and election results for the purpose of determining whether persons who were eligible to vote only the ballot for federal elections in the 2018 and following general elections received and voted the appropriate ballot.

D.  On or before December 31 each year, the committee shall compile and submit a report of its findings to the president of the senate and the speaker of the house of representatives and provide a copy of the report to the secretary of state. END_STATUTE

Sec. 2.  Delayed repeal

Section 16-604, Arizona Revised Statutes, as added by this act is repealed from and after February 1, 2026.
