AN ACT

 

amending title 23, chapter 3, Arizona Revised Statutes, by adding article 2; repealing section 41‑191.10, Arizona Revised Statutes; relating to employment agents.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 23, chapter 3, Arizona Revised Statutes, is amended by adding article 2, to read:

ARTICLE 2.  EMPLOYMENT AGENTS

START_STATUTE23-521.  Employment agents; regulation; definition

A.  An employment agent is not regulated in this state.  If an employment agent engages in an unlawful practice as prescribed in section 44‑1522, the attorney general may investigate and take appropriate action pursuant to title 44, chapter 10, article 7.

B.  For the purposes of this section, "employment agent" means a person, firm, corporation or association that for a fee, commission or charge collected from a person who is seeking employment, whether the employment agent conducts the agent's operation at a fixed place of business, on the street or as a transient and whether the operation constitutes the principal business of the agent or is only a sideline or incident to another business, does any of the following:

1.  Furnishes to a person who is seeking employment information that enables or attempts to enable the person to secure employment, including vocational guidance or employment counseling services.

2.  Furnishes to an employer that is seeking a laborer or other help of any kind information that enables or attempts to enable the employer to secure help.

3.  Keeps a registry of persons who are seeking employment or help.END_STATUTE

Sec. 2.  Repeal

Section 41-191.10, Arizona Revised Statutes, is repealed.
