HOUSE BILL 2410

 

 

 

AN ACT

 

amending title 1, chapter 5, article 1, Arizona Revised Statutes, by adding section 1-503; relating to public benefits.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 1, chapter 5, article 1, Arizona Revised Statutes, is amended by adding section 1-503, to read:

START_STATUTE1-503.  Qualifying for public benefits; exclusion of uniformed services survivor benefits in computing income; definition

A.  If qualification for a public benefit requires consideration of any component of the applicant's or beneficiary's income, any amount received by the applicant or beneficiary from the uniformed services survivor benefit plan or the reserve component survivor benefit plan shall be excluded from the computation of income.

B.  Notwithstanding subsection A, if a person is receiving benefits pursuant to title 36, chapter 29, the exclusion of these benefits from the computation of income is required only if the Arizona health care cost containment system administration has received a waiver from the centers for medicare and medicaid services to conform the requirements of subsection A with the eligibility requirements of title 36, chapter 29.

C.  For the purposes of this section, "public benefit" means any grant that is provided by this state or a political subdivision of this state or any retirement, welfare, health, disability, public or assisted housing, postsecondary education, food assistance or unemployment benefit or any other similar benefit for which payments or assistance are provided to an individual, household or family by this state or a political subdivision of this state or by appropriated monies of this state or a political subdivision of this state.
