AN ACT

 

Amending Title 20, chapter 2, article 1, Arizona Revised Statutes, by adding section 20‑241; relating to transaction of insurance business.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 20, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 20-241, to read:

START_STATUTE20-241.  Assignment of benefits; definitions

A.  A claim shall be paid by the health care insurer directly to a health care provider if the insured assigns the right to receive benefits for that care to the health care provider.  An assignment of benefits under this section does not affect or limit the payment of benefits otherwise payable by the health care insurer.

B.  For the purposes of this section:

1.  "Health care insurer" has the same meaning prescribed in section 20‑3101.

2.  "Health care provider" means:

(a)  Any person who is certified or licensed pursuant to title 32, chapter 7, 8, 11, 13, 14, 15, 15.1, 16, 17, 18, 19, 19.1, 21, 25, 28, 29, 33, 34, 35, 39, 41 or 42, title 36, chapter 4, article 6, title 36, chapter 6, article 7 or title 36, chapter 17.

(b)  Any facility that is certified or licensed under title 36, chapter 2 or 4. END_STATUTE
