AN ACT
amending section 28-892, Arizona Revised Statutes; relating to motorcycles and all‑TERRAIN VEHICLES.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 28-892, Arizona Revised Statutes, is amended to read:
28-892. Riding on motorcycle or all‑terrain vehicle
A. A person operating a motorcycle or all‑terrain vehicle shall ride only on the permanent and regular seat attached to the motorcycle or all‑terrain vehicle.
B. The operator of a motorcycle shall not carry any other person and any other person shall not ride on a motorcycle unless the motorcycle is designed to carry more than one person. On a motorcycle designed to carry more than one person, a passenger may ride on the permanent and regular seat if it is designed for two persons or on another seat firmly attached to the motorcycle at the rear or side of the operator.
C. The operator of a motorcycle or an all‑terrain vehicle shall not carry any other person and any other person shall not ride on a motorcycle or an all‑terrain vehicle unless the motorcycle or all‑terrain vehicle is designed equipped to carry more than one person. On a motorcycle or an all‑terrain vehicle designed that is equipped to carry more than one person, a passenger may ride on the permanent and regular seat if it is designed equipped for two persons or on another seat firmly attached to the motorcycle or all‑terrain vehicle at the rear or side of the operator.
