AN ACT
repealing Laws 2010, sixth special session, chapter 2, sections 6 and 7; relating to the state lottery.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Repeal
Laws 2010, sixth special session, chapter 2, sections 6 and 7 are repealed.
Sec. 2. State lottery; transfer
A. On July 1, 2012, the state lottery established pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes, succeeds to the authority, powers, duties and responsibilities of the state lottery established pursuant to title 5, chapter 5, Arizona Revised Statutes.
B. On July 1, 2012, the Arizona state lottery commission established pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes, succeeds to the authority, powers, duties and responsibilities of the Arizona state lottery commission established pursuant to title 5, chapter 5, Arizona Revised Statutes.
C. This act does not alter the effect of any actions that were taken or impair the valid obligations of the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5, Arizona Revised Statutes, in existence before July 1, 2012.
D. Administrative rules and orders that were adopted pursuant to title 5, chapter 5, Arizona Revised Statutes, continue in effect until superseded by administrative action taken pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes.
E. All administrative matters, contracts and judicial and quasi‑judicial actions, whether completed, pending or in process, of the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5, Arizona Revised Statutes, on July 1, 2012 are transferred to and retain the same status with the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes.
F. All certificates, licenses, registrations, permits and other indicia of qualification and authority that were issued pursuant to title 5, chapter 5, Arizona Revised Statutes, retain their validity for the duration of their terms of validity as provided by law.
G. All assets, including cash, inventory, equipment, records, furnishings and other property, all data and investigative findings and all appropriated monies that remain unexpended and unencumbered on July 1, 2012 of the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5, Arizona Revised Statutes, are transferred to the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes.
H. All personnel who are under the state personnel system and employed by the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5, Arizona Revised Statutes, are transferred to comparable positions and pay classifications in the respective administrative units of the state lottery or the Arizona state lottery commission established pursuant to title 5, chapter 5.1, article 2, Arizona Revised Statutes, on July 1, 2012.
