AN ACT

 

Amending title 37, chapter 2, article 9, Arizona Revised Statutes, by adding section 37-445; relating to veterans' cemeteries; providing for conditional enactment.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 37, chapter 2, article 9, Arizona Revised Statutes, is amended by adding section 37-445, to read:

START_STATUTE37-445.  Use of trust lands for veterans' cemeteries

The commissioner shall make available to the department of veterans' services parcels of trust land of up to two hundred fifty acres each for lease as veterans' cemeteries.  The parcels must be located in selected urbanized areas chosen by the department of veterans' services according to need.  The department of veterans' services shall establish and operate the cemeteries pursuant to section 41-603, subsection C, paragraph 2. END_STATUTE

Sec. 2.  Legislative finding

As trustee of lands granted to this state for the purposes enumerated in the Arizona-New Mexico Enabling Act (Act of June 20, 1910; 36 Stat. 557), the legislature finds that the lease of trust lands for veterans' cemeteries is consistent with the several objects for which the lands were granted and is an appropriate fiduciary act.

Sec. 3.  Conditional enactment

This act does not become effective unless the Constitution of Arizona is amended by vote of the people at the next general election to provide for the leasing or other disposition of lands for use as veterans’ cemeteries.
