AN ACT

 

repealing title 41, chapter 26, Arizona Revised Statutes; appropriating monies; relating to juvenile corrections.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Repeal

Title 41, chapter 26, Arizona Revised Statutes, is repealed.

Sec. 2.  Succession; maintenance of effort

A.  As provided by this act, the counties succeed to the authority, powers, duties and responsibilities of the department of juvenile corrections.

B.  All equipment, records, furnishings and other property, all data and investigative findings, all obligations and all appropriated monies that remain unexpended and unencumbered on the effective date of this act of the department of juvenile corrections are transferred to the counties as follows:

1.  Sixty percent of the appropriated monies that remain unexpended and unencumbered on the effective date of this act are allocated in equal shares to each of the fifteen counties.

2.  Forty percent of the appropriated monies that remain unexpended and unencumbered on the effective date of this act are allocated to each county based on population.

C.  The legislature shall annually appropriate an amount equal to at least $39,876,700, increased in each calendar year by the increase in the average consumer price index as published by the United States department of labor, bureau of labor statistics, allocated as follows:

1.  Sixty percent of the appropriated monies are allocated in equal shares to each of the fifteen counties.

2.  Forty percent of the appropriated monies are allocated to each county based on population.

D.  The counties may enter into intergovernmental agreements to share resources, facilities and responsibilities for juvenile offenders. Any appropriated monies that remain unexpended and unencumbered from the prior year's appropriation are continuously appropriated only for programs with documented results of reducing juvenile violations, recidivism, youth drug use and school dropout rates.

E.  The director of the department of administration shall determine and allocate the transfer, consistent with the provisions of subsection B of this section.

Sec. 3.  Conforming legislation

The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fifty-third legislature, second regular session.

Sec. 4.  Effective date

Sections 1 and 2 of this act are effective from and after June 30, 2019.
