A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §11-21-12n, relating to establishing a tax credit for owners or lessors of residential properties that allow for a first time or second chance opportunity for housing to houseless individuals, justice impacted persons, assault victims, veterans, and adults who age out of the foster care system; and providing for rule-making authority.
Be it enacted by the Legislature of West Virginia:
ARTICLE 21. PERSONAL INCOME TAX.
§11-21-12n. Tax credit for landlords to rent to certain individuals.
(a) In addition to amounts authorized to be subtracted from federal adjusted gross income pursuant to §11-21-12 of this code, owners or lessors of residential properties that allow for a first time or second chance opportunity for housing to houseless individuals, justice impacted persons, assault victims, veterans, and adults who age out of the foster care system shall be eligible for a 15% tax credit against personal income tax. The landlord must provide evidence that he or she has rented to an individual in this class for the purpose of claiming this tax incentive.
(b) The Department of Revenue may promulgate legislative rules pursuant to §29A-3-1 et seq., of this code as necessary to implement the provisions of this section.
NOTE: The purpose of this bill is to establish a tax credit for owners or lessors of residential properties that allow for a first time or second chance opportunity for housing to houseless individuals, justice impacted persons, assault victims, veterans, and adults who age out of the foster care system. The bill also provides for rule-making authority.
