A BILL to repeal §16-5Q-2 and §16-5Q-4 of the Code of West Virginia, 1931, as amended, and to amend and reenact §16-5Q-1, relating to the James "Tiger" Morton Catastrophic Illness Fund; abolishing the fund and requiring that all appropriations to the fund be deposited in the State's General Fund.

Be it enacted by the Legislature of West Virginia:

            That §16-5Q-2 and §16-5Q-4 of the Code of West Virginia, 1931, as amended, be repealed and that §16-5Q-1 of said code be amended and reenacted to read as follows:

ARTICLE 5Q. THE JAMES "TIGER" MORTON CATASTROPHIC ILLNESS FUND.

§16-5Q-1. Creation Termination of the James "Tiger" Morton catastrophic illness fund.

            (a) The Legislature finds that the " James 'Tiger' Morton Catastrophic Illness Fund" is duplicative of existing federal programs.

            (b) The" James 'Tiger' Morton Catastrophic Illness Fund is hereby terminated and the James 'Tiger' Morton Catastrophic Illness Commission is hereby abolished. Effective immediately, moneys in the fund created in the State Treasury, designated the "James 'Tiger' Morton Catastrophic Illness Fund" shall be deposited in the State's General Fund distributed in accordance with the provisions of this article. The purpose of this fund is to provide a source of economic assistance to the citizens of this state facing catastrophic illness. In addition to any funds appropriated by the Legislature, the Tiger Morton Fund may receive donations of cash or property from other sources, including gifts, grants, or donations from any source whatsoever. After appropriation by the Legislature, the catastrophic illness commission may make expenditures from the fund as necessary to accomplish the purposes of this article.

 


            NOTE: The purpose of this bill is to abolish the James "Tiger" Morton catastrophic illness fund and commission, and to require that all appropriations to the fund to the be deposited in the state's General Fund.
