A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §22-5-12a, relating to requiring public hearing for applicant of air quality permit for a facility with investment value exceeding $25 million or with size of 20,000 square feet or larger; where hearing is to be held.
Be it enacted by the Legislature of West Virginia:
ARTICLE 5. AIR POLLUTION CONTROL.
§22-5-12a. Public hearing required for applicant for air quality permit relating to facility of certain investment value or size.
The director shall hold a public hearing, in the county where the facility is to be located, for any applicant for an air quality permit for a facility which will have an investment value of more than $25 million or be 25,000 square feet or larger in size.
NOTE: The purpose of this bill is to require public hearings on air quality permits for large facilities, in the county where the facility is to be located.
