A BILL to amend and reenact §64-5-1 of the Code of West Virginia, 1931, as amended, relating to authorizing the Department of Health and Human Resources to promulgate a legislative rule relating to public health standards for businesses remaining open during the COVID-19 outbreak.
Be it enacted by the Legislature of West Virginia:
ARTICLE 5. Authorization for Department of health and human resources to promulgate legislative rules.
§64-5-1. Department of Health and Human Resources.
The legislative rule filed in the State Register on August 28, 2020, authorized under the authority of §16-3-1 of this code, modified by the Department of Health and Human Resources to meet the objections of the Legislative Rule-Making Review Committee and refiled in the State Register on December 15, 2020, relating to the Department of Health and Human Resources (public health standards for businesses remaining open during the COVID-19 outbreak, 64 CSR 114), is authorized.
NOTE: The purpose of this bill is to authorize the Department of Health and Human Resources to promulgate a legislative rule relating to public health standards for businesses remaining open during the COVID-19 outbreak.
