A BILL to amend the Code of Virginia by adding in Title 2.2 a chapter numbered 55.3, consisting of sections numbered 2.2-5514 and 2.2-5515, relating to the payment of public employees for time away from their official duties for the benefit of any labor union, labor organization, or employee organization; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Title 2.2 a chapter numbered 55.3, consisting of sections numbered 2.2-5514 and 2.2-5515, as follows:

CHAPTER 55.3.
PAYMENT OF PUBLIC EMPLOYEES FOR TIME BENEFITING UNIONS.

§2.2-5514. Paying public employees for certain activities prohibited.

No public employer shall pay leave or benefits to any public employee to directly or indirectly work for or on behalf of an employee organization, professional association, labor union, or labor organization.

§2.2-5515. Penalty.

Any person, firm, association, corporation, employee organization, labor union, or labor organization that violates any provision of this chapter is guilty of a Class 5 felony.

2. That the provisions of this act are declarative of existing law.

3. That the provisions of this act may result in a net increase in periods of imprisonment or commitment. Pursuant to §30-19.1:4, the estimated amount of the necessary appropriation is $0 for periods of imprisonment in state adult correctional facilities and is $0 for periods of commitment to the custody of the Department of Juvenile Justice.
