A BILL to amend the Code of Virginia by adding in Chapter 9 of Title 63.2 a section numbered 63.2-916, relating to local directors; consent to treatment and collection of evidence.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 9 of Title 63.2 a section numbered 63.2-916 as follows:

§63.2-916. Consent to surgical and medical treatment and collection of forensic evidence.

The local director or his designee may (i) consent, in accordance with the provisions of §54.1-2969, to surgical or medical treatment of a minor who has been committed to the care and custody of the local board by a court of competent jurisdiction, entrusted to the local board by his parent or guardian, or taken into the custody of the local board pursuant to §63.2-1517, or (ii) consent to the collection of forensic evidence on behalf of a minor who has been committed to the care and custody of the local board by a court of competent jurisdiction, entrusted to the local board by his parent or guardian, or taken into the custody of the local board pursuant to §63.2-1517 in cases in which the minor is believed to be the victim of sexual assault.
